On July 21, 2008 , the Lexington City Council voted to annex four areas of Davidson County .  This comes after meetings with Lou Smith to discuss discrepancies in cost associated with the cost of the annexation, various protest, and other attempts to stop Lexington.

            After a short update on the amendments from John Gray, the city council led by John Gray approved the amendments.  After a few comments from Victor Kiger the council voted unanimously.  This means that on June 30, 2009 the Sapona Country Club, Rolling Park , Cow Palace , Biesecker Road area, and Winston Road areas will go into the city unless something is done.

A quick message for those who are in the forced annexation areas.

After the Lexington City Council voted to adopt the annexation ordinance, the Board of Directors of Citizens Against Forced Annexation voted to pursue legal action and would file a civil suit against the City  of Lexington.  Also CUAFA advised homeowners to fill out the forms for "Request of Sewer Service" .

Update: on the legal front the attorneys are doing due diligence and gathering data from surveying companies and comparing it to the Annexation Ordinance data.  We should be ready to file suit in two weeks.  This is before the 60 day deadline.   Robert Hornick of The Brough Law Firm will be first to file for Larry Harvey and Atlantic Car Company.  Matt Roberson of Adams, Hendon, Carson, Crow and Saenger will follow.

If you requested sewer you probably received a registered letter from the city.  Please keep this and make a copy.  This will be used as evidence in our civil suit.  If you can drop a copy to one of the officers of CUAFA, it would be helpful.  We will send to the attorneys.

Other items is that Clint Legette resigned due to health concerns but further testing was favorable.   I will assume President duties until we have a board meeting in the next two weeks.  We plan to follow with a larger meeting after we file the civil suit to advise everyone.

Please remember that we need your donations to make this happen.  We are preventing the city from taxing each home in the amount of $1000 to $7000 per year plus the cost of sewer installation and plumbing bills.  We have asked people to give 1/2 the amount of their county tax .  Some of those giving are resolved to keep the city out.  This will save us tens of thousands of dollars in the long run.   Please discuss with your neighbors and let them know you gave and is important for them to give to spread the burden of the legal fees.  

Finally,  I am confident that the city headed by John Walser will be delayed in annexing us!!.  They will incur more costs!!  They will have to remedy their plans and maybe stop altogether their attack on the county's land owners.

 Tomorrow will be  a sad day for many Davidson County citizens. Attorney Robert Hornik Jr. of the Brough Law Firm in Chapel Hill, NC will file a lawsuit Tuesday, 9/16/08 at 1:30pm at the Davidson County Courthouse.The suit is against the City of Lexington to challenge the Forced Annexation. Citizens United Against Forced Annexation had hoped it would not come to this. Over 1600 names were presented on petitions to the City Council, letters were written to the Mayor and Council, petitioners spoke at City Council meetings, Letters to the Editor were written, pleads were made at the Civic Center during the informational and public hearing meetings, even protests marches were held. All this fell on deaf ears. Our voice was not heard. Ligation was our last resort. We have over 100 petitioners who have joined the lawsuit. Why the lawsuit? CUAFA believes hostile annexations are wrong and we will continue to fight in Raleigh for change. Hostile annexations hurt people.We are fighting for Tommy Cox, a Korean War disabled veteran, who fears loosing his home. We are fighting for Lorraine Furr who recently underwent brain surgery and bravely spoke to the City Council expressing how the increased taxes would be a hardship on her family. We are fighting for Barbara Blackburn. She is a widow, who works at a rest home, through tears she told the City Council she couldn't take another financial burden. We are fighting for the many others who fear loosing their homes or having to choose between buying medication or paying more taxes.
 Boycott
CUAFA are not recommending a boycott of Lexington businesses. According to the Dispatch's Forum and Keith Bost a grass root effort has emerged and individuals have begun to boycott. They are asking owners to support us by speaking to the city government. 
 City Elections
CUAFA  has begun to organize a petition to eliminate the Ward system for electing City Council members. Under G.S. 160A-104 10 percent of the quatified voters of Lexington could force an election so that every voter would be able to vote on every council member. We will soon begin collecting signatures to give Lexington residents a choice .   Thomasville recently made this change.
